Version v3
Terms of Service
1. WHO WE ARE. Iron Pulse Athletica provides online fitness coaching, training programs, and general nutrition guidance through this platform. 2. ELIGIBILITY. You must be at least 18 years old to use this service. You must provide accurate information about yourself, including your date of birth and health history. We may close an account where the stated age is not accurate. 3. WHAT YOU GET. Your plan determines the features available to you, including whether your programs are reviewed by a coach before release, whether you can message a coach, and whether video form checks and scheduled calls are included. Features may change over time. 4. WHAT THIS IS NOT. This service does not provide medical advice, diagnosis, treatment, physical therapy, or medical nutrition therapy. See the Medical Disclaimer. Your coach is a fitness professional, not a clinician. 5. HOW PROGRAMS ARE MADE. Programs and nutrition targets are built on coach-authored programming, applied to your individual answers with the assistance of automated systems, and reviewed by a coach on the plans that include review. See the AI Disclosure for the detail. 6. YOUR RESPONSIBILITIES. You agree to give accurate health information and to keep it current; to stop and seek medical attention if you feel unwell; to exercise judgement about what is safe for you on a given day; and not to share your account. 7. PAYMENT. Subscriptions bill in advance on a recurring basis until cancelled. Prices are shown before purchase. Taxes may apply. 8. CANCELLATION AND REFUNDS. You may cancel at any time from your billing settings. Cancellation stops future charges. Except where required by law, payments already made are not refunded, including for unused time in a period you have paid for. If you believe you have been charged in error, contact us and we will look at it. 9. COMMUNITY. If you post to the community feed you are responsible for what you post. Do not post anything unlawful, harassing, hateful, sexually explicit, or that discloses another person's private information. Do not give medical advice to other members. We may remove content and suspend accounts at our discretion. You keep ownership of what you post and grant us permission to display it within the platform. 10. PROGRESS PHOTOS. Photos you upload are stored as part of your private record and shown only to you and your coach. We will not use them in marketing without asking you separately and getting your agreement in writing. 11. TERMINATION. You may stop using the service at any time. We may suspend or terminate an account that breaches these terms, or where continuing to provide programming would be unsafe. 12. LIMITATION OF LIABILITY. To the fullest extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited by law, including for gross negligence or willful misconduct. 13. DISPUTES. These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. [ATTORNEY TO ADVISE: whether to include a binding arbitration clause and class action waiver, and the venue for disputes. Arbitration clauses have specific formatting and consent requirements and should not be added without review.] 14. CHANGES. We may update these terms. Material changes will be notified to you, and continuing to use the service after that constitutes acceptance. 15. CONTACT. Questions about these terms: hello@ironpulseathletica.com
Age requirement
You must be at least 18 years old to use Iron Pulse Athletica. By continuing you confirm that you are 18 or over. We are not set up to coach minors. If you are under 18, training with a coach in person — or through your school or club — is a better fit than an automated program, and calorie targets in particular should come from a physician or registered dietitian rather than an app.
Medical disclaimer
Iron Pulse Athletica provides general fitness and nutrition information. It is not medical advice, not medical nutrition therapy, and not a substitute for consultation with a physician, registered dietitian, or other qualified healthcare provider. No coach-client relationship created through this platform is a medical or clinical one. You should consult a physician before beginning any exercise or nutrition program, and particularly if you have any pre-existing health condition, are pregnant or postpartum, are over the age of 65, take prescription medication, or have answered "yes" to any question on the health screening. Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, faintness, shortness of breath, or any other concerning symptom. Nobody is supervising your sessions in real time, and this platform cannot detect that you are in difficulty. Training programs, macro targets, and any other recommendation produced through this platform are general in nature. They may not be appropriate for your individual medical circumstances, and they are not a diagnosis or a treatment plan.
How your program is made
Your training is built on programming written by the coach behind Iron Pulse Athletica. The exercise selection, the way each four-week phase progresses, how injuries and medical conditions are worked around, and the standards your nutrition targets are held to were all designed and chosen by a person, not taken off a shelf. Software applies that programming to your own answers — your body, your goal, your equipment, your injuries, the days you can train, and how your last phase actually went. That step uses automated systems, including artificial intelligence, and it is what allows a program written specifically for you to be ready in minutes instead of weeks. On plans that include coach review, your coach reads every phase before it is released to you and adjusts it where their judgement says it needs adjusting. Where your health screening flags a condition that calls for it, that review is mandatory and nothing is released until it has happened. On plans without coach review, your program is released to you directly, and you can move up a plan at any time if you want a person's eyes on it. No system, automated or human, is infallible. A program can misjudge your capacity, misread your history, or suggest something that does not suit you on a given day. Treat it as a plan to be adjusted, not an instruction to follow past the point of comfort or good sense. If something looks wrong for you, do not do it — message your coach.
Assumption of risk and liability waiver
By using Iron Pulse Athletica, you acknowledge that physical exercise carries inherent risks, including but not limited to muscle strain, joint injury, aggravation of pre-existing conditions, cardiovascular events, and in rare cases serious injury or death. You voluntarily assume all risks associated with participation in any workout program, nutrition plan, or activity recommended through this platform, whether or not those risks are specifically described here. You confirm that the information you have given in your health screening is true and complete to the best of your knowledge, and you agree to update it if your circumstances change. Programming decisions are made from what you tell us; incomplete or inaccurate information may result in a program that is unsafe for you. You release and hold harmless Iron Pulse Athletica, its owners, coaches, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from your participation, to the fullest extent permitted by applicable law. This release does not apply to injury caused by gross negligence, recklessness, or willful misconduct, and does not limit any right you have that cannot be waived under the law of your jurisdiction. If any part of this waiver is held unenforceable, the remainder continues to apply.
